BARKING DOGS
What you can do about it

Sure, we get it – animals get spooked by delivery trucks or unexpected guests. But leaving your dog unattended in your yard to bark uncontrollably or for extended periods is inconsiderate and technically against city ordinance.

The Board doesn’t have any enforcement powers in such matters; it’s a neighbor-to-neighbor or city issue. But annoyed residents have options:
  • Address the neighbor nicely and directly. We know that may be awkward for some, but sometimes neighbors don’t realize their pets are annoying.
  • Leave the neighbor an anonymous note stating your concern. Don’t be threatening. Simply state their disruptive pet isn’t being neighborly.
  • File a complaint with the city of Indianapolis. Contact the Mayor’s Action Center here: https://www.indy.gov/activity/how-to-report-animal-complaints
The animal nuisance ordinanceSec. 531-204 - Animals causing nuisance prohibited. (a) It shall be unlawful for a person to own or keep any animal which by frequent or habitual howling, yelping, barking, screeching, other vocalization or otherwise shall cause serious annoyance or disturbance to persons in the area. (b) A person who violates any provision of this section shall be punishable as provided in section 103-3 of this Code; provided, however, a fine imposed for the first such violation shall not be less than $25; subsequent or continued violations may also subject the owner to impoundment of the animal by a person having authority to impound such an animal.


PARKING
Legal parking rules apply in our neighborhood

Eagle Nest does not own our neighborhood roads, the city does. And that means residents are required to park correctly along our development’s streets. Cars should be parked in the direction of traffic flow, not against it. It's a safety thing, as vehicle tail ends have more reflectors than front ends. It’s also the law. Indianapolis City Code states:

Sec. 621-108 - Manner of parking. (a) Parallel to curb. Parallel-to-curb parking shall be required and be used wherever parking is permitted on the streets and public places of the city, except as otherwise specifically permitted or provided by subsections (b) and (c). Parallel-to-curb parking means parking with the curb side wheels of the vehicle within twelve (12) inches of the curb with the vehicle headed in the direction of the permitted traffic flow in the adjacent traffic lane.

Sure, we understand it’s easy to temporarily roll up to a house on the driver side to drop off a package or letter, but residents should not park that way overnight or for extended periods. If you see the latter happening on a regular basis, the Board encourages you to file a complaint/contact the IMPD parking division to investigate and cite the vehicle owner.

SOLICITING
Know your rights to privacy

As you know, solicitors often come and go with the seasons. But residents have rights to their privacy and property, regardless of whether solicitors claim they have a license (there is no such thing in Marion County) or were "assigned to our neighborhood by their manager." (That may be, but that means nothing to our lot owners.)

Following are a few tips for handling unwanted solicitors:
  • If you see anything suspicious, call 911 immediately. It's better to be safe than sorry. Police would rather respond to a false alarm than an after-the-fact crime scene. Your Board of Directors agrees.
  • The only legal protection you have from solicitors is to display a "no soliciting" sign, sticker or placard in clear view of your front door. That way, if a solicitor rings your doorbell, you can press trespassing charges. Call 911 immediately.
  • The "no soliciting signs" at our entrances are a warning but they are not legally binding. They simply send a signal that the Eagle Nest Property Owners Association does not endorse soliciting.
  • If a solicitor ignores instructions to leave your property or you feel threatened, call 911 and request a patrol car immediately. Let the police determine whether a crime was committed.
