Signage Policy

The Eagle Nest Signage Policy was updated and approved by the Board of Directors on January 31, 2020, and it was recorded with Marion County on February 23, 2021, as part of the Association's Declaration of Restrictions.

Why the policy was updated
To codify and adopt standards, ensure consistency and provide legal standing for corrective action regarding promotional signage throughout the neighborhood, as well as maintain and promote neighborhood aesthetics.

What the ENPOA Declarations of Restrictions say
The Declarations of Restrictions (Dec. 22, 1977), Section 5(B) - General Prohibitions states: "No signs or advertisements shall be displayed or placed on any lot or structure in the Development without the prior written approval of the Committee." The signage policy is part of the Declaration of Restrictions.

What you need to do
All signs – even if previously approved – must be approved per the new policy. Email your request and a photo of the sign to RulesRestrictions@att.net.

What if my sign was approved before February 23, 2021?
Now that our updated policy has been recorded, we are wiping the slate clean and starting from scratch with all properties. While most signs currently on display meet the new standard(s), a request for approval still must be submitted for Association records.

Eagle Nest Signage Policy

Approval
All signs on Eagle Nest residential lots and common grounds (also known as the Development) can only be displayed after written approval from the Rules and Restrictions Committee (also known as the Committee). Contact the Committee at

Acceptable Signs

All signs must comply with the Indiana Code 32-21-4 through IC 32-21-13-6, as well as adhere to the Development's aesthetics as determined by the Committee. Signs must be printed or painted and non-illuminated.

The following types of signs are acceptable and do not need Committee approval:

  • ENPOA and/or Board business or activities
  • Elections for candidates (national, state, county and city elections)
  • Garage sales
  • Not-for-profit associations
  • For Sale or Open House realty signs
  • School athletes provided by districts (not homemade) and school fundraising events
  • Utility/municipal repairs

Dimensions
No sign shall not exceed 5 feet in width or height.

Number of Signs
The Committee reserves the right to determine the number of the signs per lot, but in general no more than five (5) are permitted. 

Placement
Placement of signs shall not restrict the view of a vehicle or pedestrian on any street, sidewalk or intersection of streets within the Development. General guidance:

  • Lots: Signs may be placed in front of the residence set back a minimum of four feet from the curb. (For lots with sidewalks, that generally means signs should be placed in the yard, not the grassy parkway). Student athlete signs may be affixed over garages, not front doors or in yards.
  • Common Grounds: Signs are not permitted in the landscaped entrance medians. Signs can be placed on either side of the Development's entrances at 75th Street, Hague Road and East 82nd Street and set back a minimum of four feet from the street. Only Association signs are permitted at the Clubhouse or on the common ground medians.
  • Light poles or Street Signs: Signs shall not be attached to light poles, utility poles, stop signs or other traffic street signs within the Development.

Display Period
Signs shall only be displayed in accordance with the following periods:

Homeowners:

  • Election signs are permitted 60 days before and six days after an election, per Marion County Ordinance. Election signs are defined as a candidate for a specific position, political parties, ballot measures or referendums.
  • Garage sale signs may be displayed 24 hours before and on the day of the sale.
  • Not-for-profit associations or local school event signs shall not be displayed more than 30 days from the published date and must be removed after the event.
  • Commercial contractor signs shall only be displayed while the contractor is working at the residence and must be removed at the end of the project.
  • Student athlete signs should be removed when not in season. 

Realtors:

  • Only one For Sale sign per lot. A single informational box with flyers is permitted.
  • For Sale signs shall not be displayed more than 90 consecutive days.
  • Open House signs and accompanying directional signage can only be displayed one day before the event and must be removed immediately afterward.
  • For Sale or Open House signs cannot be displayed on any of the medians at Eagle Nest's entrances (75th Street, Hague Road or East 82nd Street). However, such signs may be displayed on either side of the entrances in the public right of way as long as they do not obstruct motorists' view at any entrance.

Violations
Signs in violation of these rules will be removed and disposed of by the Board or the Committee.
